These Terms & Conditions ("Terms") govern your access to and use of Foke — the vertical short-drama streaming application for iOS and Android operated by Foke Studios ("Foke Studios", "we", "us", or "our") — together with this website and any related services (collectively, the "Service"). Please read them carefully before using the Service.

1. Acceptance of Terms and Eligibility

By downloading, installing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.

You must be at least 13 years of age to use the Service. If you are under the age required to form a binding contract in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

2. Account Registration and Security

To use most features of Foke, you must create an account by verifying your mobile phone number with a one-time password (OTP) delivered via Firebase Authentication. We do not use or store account passwords. During or after sign-up you may also choose a display name or username.

• You must provide a phone number that you own or are authorised to use.
• You are responsible for all activity that occurs under your account and for keeping your device and the SMS messages containing OTP codes secure.
• Do not share OTP codes with anyone. We will never ask you for an OTP code.
• Notify us promptly at babashotsapp@gmail.com if you believe your account has been accessed without your authorisation.

3. License to Use the Service

Subject to your compliance with these Terms, Foke Studios grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Foke app on devices you own or control, and to stream content through the Service, solely for your personal, non-commercial entertainment. All rights not expressly granted to you are reserved by Foke Studios and its licensors.

4. Content Ownership and Intellectual Property

All shows, episodes, videos, artwork, trailers, text, graphics, logos, and other materials made available through the Service ("Content") are owned by or licensed to Foke Studios and are protected by copyright, trademark, and other intellectual property laws. Content is delivered with digital rights management (DRM) protection.

• You may not download, record, rip, capture, copy, or otherwise reproduce Content except through features we expressly provide within the app.
• You may not redistribute, publicly perform, publicly display, broadcast, sell, rent, or otherwise make Content available to third parties.
• You may not circumvent, remove, disable, or interfere with DRM or any other content protection or access-control measure used by the Service.

5. User Conduct

You agree to use the Service only for lawful purposes. In connection with your use of the Service, you must not:

• reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the app, except where such restriction is prohibited by applicable law;
• scrape, crawl, harvest, or use bots, scripts, or other automated means to access the Service or extract data or Content from it;
• probe, scan, or test the vulnerability of the Service, interfere with its operation, or impose an unreasonable load on our infrastructure;
• impersonate any person, misrepresent your affiliation with anyone, or use another person's phone number or account;
• use the Service to harass, abuse, defame, or harm others, or in violation of any applicable law or regulation; or
• resell, rent, or commercially exploit the Service or access to it without our prior written consent.

6. Purchases and Subscriptions

Where the Service offers paid features, subscriptions, or in-app purchases, those purchases are billed and processed by the app store from which you downloaded the app (the Apple App Store or Google Play). Your purchase is subject to the applicable store's terms of service and payment policies in addition to these Terms.

Refunds, cancellations, and subscription management are handled by the relevant app store under its own policies; Foke Studios does not process payments directly and generally cannot issue refunds on a store's behalf. Prices, features, and availability of paid offerings may change, and we will communicate material changes as required by the applicable store rules and law.

7. Advertising

The Service may display advertisements, including ads served through Google AdMob. Advertisements may be targeted based on information described in our Privacy Policy. We are not responsible for the content of third-party advertisements or for the products and services they promote, and your dealings with advertisers are solely between you and the advertiser.

8. Availability and Changes to the Service

We are continuously developing the Service. We may add, modify, or remove features, Content, or catalog titles at any time, and Content availability may vary by region and change without notice. We do not guarantee that the Service, or any particular Content, feature, or device compatibility, will always be available, uninterrupted, or error-free. We may suspend the Service, in whole or in part, for maintenance, security, legal, or operational reasons.

9. Termination and Account Deletion

You may stop using the Service at any time. You can delete your account from within the app (Settings → Delete Account) or by following the instructions on our account deletion page. Deleting your account removes your profile and associated data as described in our Privacy Policy.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, created risk or possible legal exposure for us, or where required by law. Sections of these Terms that by their nature should survive termination — including intellectual property provisions, disclaimers, limitations of liability, and indemnification — will survive.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service and all Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors, viruses, or other harmful components, or that defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Foke Studios and its directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid to us through the Service in the twelve (12) months preceding the event giving rise to the claim, and (b) one thousand Indian Rupees (INR 1,000). Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Foke Studios and its directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of the Service or Content, or your violation of any law or the rights of any third party.

13. Governing Law and Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of India, without regard to its conflict-of-laws principles. Subject to any mandatory provisions of applicable law, the courts of India will have exclusive jurisdiction over such disputes, and you consent to the personal jurisdiction of those courts.

Before filing a claim, you agree to first contact us at babashotsapp@gmail.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, our practices, or applicable law. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice within the app or by other reasonable means. Your continued use of the Service after updated Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
